1. This promotion is free to enter. The promotion is in the form of a Competition. The Competition is open only to those who enter on Facebook, Twitter and LinkedIn and who are 18 years of age or older as of the date of entry. It does not require nor involve any purchase or payment by you. The Competition is only open to legal residents of the United Kingdom. Employees of Vista Health or InHealth Group and its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Competition. 2. Agreement to Rules: By participating as a contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of Vista Health as final and binding as it relates to the content of this Competition.
3. Competition Period: Entries will be accepted online starting on 17th June at 11am until 17th July at 11am in the United Kingdom.
4. How to Enter: The Competition must be entered by submitting the entry rules on the selected social media pages. The entry must fulfil all Competition requirements, as specified, to be eligible to win the prize. Entries that are incomplete or do not adhere to these Rules may be disqualified at the sole discretion of Vista Health. You may enter only once. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Vista Health.
5. The Winner of the Competition (the “Winner”) will receive a Shiatsu Massager (A massager essential for ultimate massage effect to eliminate fatigue and relax) worth £33.99 at its 17th June published retail price. The actual / appraised value may differ at time of the prize award. No cash or other prize substitution shall be permitted except at Vista Health’s sole discretion. The prize is non-transferable. Acceptance of the prize by the Winner constitutes permission for Vista Health to publish the Winner’s name on its website or make the winners name available on receipt of a request pursuant to Clause 12 as well as use the Winner’s name, likeness, and entry for purposes of advertising and trade without any further compensation, unless prohibited by law.
6. Winner Selection and Notification: The winner will be selected by a random drawing under the supervision of Vista Health. The winner will be notified by social media direct message within five working (5) days following selection of Winner. Vista Health shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, or fails to claim the prize within 14 days from the time award notification was sent, the prize may be forfeited and an alternate Winner selected.
7. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that Vista Health, shall have the right to print, publish, broadcast, distribute, and use in any media in perpetuity and throughout the world, without limitation, your entry, name and any picture supplied, and your biographical information whether for publicity, information, advertising, public relations, and promotional purposes without the need to pay any compensation, nor without any further notice, review, or consent from yourself.
8. Terms & Conditions: Vista Health reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Competition should a virus, bug, a non-authorized human intervention, fraud, or other cause beyond Vista Health’s control corrupt or affect the administration, security, fairness, or proper conduct of the Competition. In such case, Vista Health may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Vista Health. In addition, Vista Health may disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Competition or website or violates these Terms & Conditions.
9. Limitation of Liability: By entering, You agree to release and hold harmless Vista Health and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: Your participation in the Competition and the Winner’s acceptance, possession, use, or misuse of any prize or any portion thereof. Vista Health excludes all liability for any punitive, incidental, or indirect loss or damages or for any unauthorized human intervention in any part of the entry process or the Competition; or any electronic or human error in the administration of the Competition or the processing of entries.
10. Disputes: These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the English and Welsh Courts.
